This Privacy Policy explains how To Best Universities Inc, a corporation organized under the laws of the State of Delaware with its principal office at 99 Wall St, Suite 3899, New York, NY 10005 ("To Best Universities", "we", "us", or "our"), and our affiliates collect, use, share, and protect personal information when you use our websites, mobile and web applications, and the tutoring, test-preparation, and educational-consulting services we make available (collectively, the "Services"). It applies to all visitors and users, including prospective and current customers, students, parents, independent tutors, and consultants. By using the Services, you agree to this Policy. If you do not agree, please do not use the Services.
1. Information We Collect
(a) Information you provide
We collect information you give us directly, such as your name, email address, telephone number, and mailing address; account credentials; payment and billing information; a student's school, grade level, subjects, goals, and academic records; the professional credentials, experience, and background of a tutor or consultant; and any content you submit, such as messages, reviews, and application materials.
(b) Information collected automatically
When you use the Services, we automatically collect certain information, such as your IP address, device and browser type, operating system, language and time-zone settings, the pages and content you view, the links you click, and the dates and times of your visits. We collect this information using cookies and similar technologies described in Sections 4 and 5.
(c) Information from third parties
We may receive information about you from third parties, such as a parent or guardian who provides a student's details, a person who refers you to us, a school or organization that arranges services, or a social-login or payment provider you choose to use.
2. How We Use Information
We use personal information to provide, operate, and improve the Services; to match students with suitable tutors and consultants; to schedule sessions and process payments; to communicate with you about your account, transactions, and support requests; to personalize your experience; to send marketing where permitted; to measure and analyze usage; to ensure security and prevent fraud; to comply with legal obligations; and to establish, exercise, or defend legal claims.
Where the law requires it, we rely on your consent for marketing communications and for certain cookies, and you may withdraw that consent at any time as described in Section 8.
Your profile picture, any likeness we create from it (including AI-enhanced, illustrated or manga-style, or stock stand-in versions), and your written reviews are private by default and appear in the public-facing portions of our Services only with your separate, opt-in consent, which you may withdraw at any time; we do not sell them and do not provide them to third parties for their own advertising. We collect a student's date of birth (student accounts only) and use it to provide age- and grade-appropriate tutoring, to determine whether parental consent is required before any public display, and to comply with children's-data rules; a student's age and minor status are derived from that date of birth.
3. How We Share Information
We share personal information with service providers and processors who perform functions on our behalf, such as payment processing, hosting, email and messaging, and analytics, under contracts that limit their use of the information; with the tutors and consultants matched to a student, to the extent needed to deliver the Services; and with our affiliated companies.
We may also disclose information in connection with a merger, acquisition, financing, reorganization, or sale of assets, and when we believe disclosure is necessary to comply with law, enforce our agreements, or protect the rights, property, or safety of To Best Universities, our users, or the public. We do not sell the personal information of students, and we do not provide student data to third parties for their own advertising.
4. Cookies, Tracking Technologies, and Analytics
We and our providers use cookies, web beacons, pixels, and similar technologies to keep you signed in, remember your preferences, measure performance, and understand how the Services are used. We use analytics tools such as Google Analytics and the Meta Pixel for these purposes.
You can control cookies through your browser settings and can opt out of certain analytics and advertising through the controls those providers offer, including the Google Analytics opt-out. Blocking some cookies may affect how the Services function.
5. Local Storage and Similar Technologies
The Services use browser local storage and similar client-side technologies to remember settings such as your language, theme, and partially completed forms so that your experience is consistent across visits. You can clear this storage through your browser settings, though doing so may reset your preferences.
6. Interest-Based (Behavioral) Advertising
We may work with advertising partners that use cookies and identifiers to show you interest-based ads on other sites and services based on your activity over time. You can opt out of many interest-based ads through the Digital Advertising Alliance and the Network Advertising Initiative opt-out tools, and through your device's advertising settings. We do not use interest-based advertising that relies on the personal information of children.
7. Social Media Features and Widgets
The Services may include social-media features and embedded content, such as share buttons or links to our profiles. These features may collect your IP address and the page you are visiting and may set a cookie. They are operated by the third parties that provide them and are governed by those providers' privacy practices, not this Policy.
8. Your Choices and Rights
You may update your account information at any time, opt out of marketing email by using the unsubscribe link or replying STOP to marketing texts, and manage cookies and local storage through your browser. Where required by law, we honor browser-based privacy preference signals, such as the Global Privacy Control, as a request to opt out of the sale or sharing of personal information for the browser through which it is sent.

9. Data Retention
We retain personal information for as long as needed to provide the Services, to maintain your account, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. When information is no longer needed, we delete it or de-identify it. Retention periods vary depending on the type of information and the purpose for which it was collected.
10. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. 11. Children's Privacy (COPPA) and Student Education Records (FERPA)
We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under 13 except the minimal information needed to match a student with a tutor or consultant and deliver sessions, which is provided and authorized by a parent or guardian. A parent or guardian may review, update, or request deletion of a child's information by contacting us at privacy@tobestuniversities.com.
Where we handle student education records on behalf of a school or district subject to the Family Educational Rights and Privacy Act (FERPA), we act as a "school official" with a legitimate educational interest, use those records only to provide the agreed Services, and do not use them for any other purpose or disclose them except as the school directs or the law permits.
For a student under the age of eighteen, we do not publicly display or use the student's profile picture, likeness, or written reviews for promotion unless we have obtained both the verifiable consent of the student's parent or legal guardian and the student's own agreement, either of whom may withdraw that consent at any time; when consent is withdrawn we stop the public display and delete the public copies within our control. We determine whether a student is a minor from the date of birth provided at registration.
12. Tutor and Consultant Profiles
To help customers choose a Professional, we display profile information for our tutors and consultants, such as name or display name, subject expertise, qualifications, and a biography. Professionals can review and request changes to their profile through their account or the terms of their contractor agreement.
13. U.S. State Privacy Rights
Depending on your state of residence, you may have rights to access the personal information we hold about you, to correct inaccurate information, to delete information, to obtain a portable copy, and to opt out of the sale or sharing of personal information and of targeted advertising. We do not sell personal information as that term is commonly understood, and we do not sell or share the personal information of students.
Residents of California (under the California Consumer Privacy Act as amended by the California Privacy Rights Act, including the right to limit the use of sensitive personal information and the "Shine the Light" right), Virginia, Colorado, Connecticut, Utah, and other states with comprehensive consumer-privacy laws may exercise these rights by contacting us at privacy@tobestuniversities.com. We will verify your request using the information associated with your account, you may use an authorized agent where the law allows, and we will not discriminate against you for exercising your rights. If we decline a request, you may appeal by replying to our response.
14. International Users and Data Transfers
We operate in the United States, and your information will be processed and stored in the United States, which may have data-protection laws different from those of your country. Where the European Union or United Kingdom General Data Protection Regulation applies, you have rights of access, rectification, erasure, restriction, portability, and objection, and we rely on lawful bases including your consent, the performance of a contract, and our legitimate interests. 15. Links to Third-Party Sites
The Services may link to third-party sites and services that we do not control. This Policy does not apply to those sites, and we are not responsible for their privacy practices. We encourage you to review the privacy notices of any third party before providing your information.
16. Changes to this Policy
We may update this Policy from time to time by posting the revised version on this page with a new effective date and, where the change is material, by providing additional notice such as an email or an on-site message. Your continued use of the Services after a change becomes effective constitutes your acceptance of the updated Policy.
